In July, the Washington Supreme Court jettisoned the longstanding definition of “disability” under the Washington Law Against Disability. See McClarty v. Totem Elec., 157 Wash.2d 214, 137 P.3d 844, 18 A.D. Cases 217 (Wash. Jul 06, 2006). WELA filed an amicus brief seeking reconsideration, as did the Washington Human Rights Commission, but the Court denied reconsideration.

The Washington Legislature is considering bills that would restore the longstanding definition of disability.  Different versions of the legislation have passed both the House and Senate and we remain cautiously optimistic that the legislation will become law this session.
